Current NJ Abortions Laws 

 

New Jersey does not have an informed consent law or an enforceable parental

involvement law for abortion (New Jersey 2014 Report Card). 

 

New Jersey requires that abortions after the first trimester be performed in

licensed ambulatory care facilities or hospitals (New Jersey 2014 Report Card). 

 

New Jersey does not require infants who survive an abortion to be given

appropriate, potentially life-saving medical care (New Jersey 2014 Report Card).

 

New Jersey has a “Baby Moses” law, establishing a safe haven for mothers

to legally leave their infants at designated places and ensuring the infants

receive appropriate care and protection (New Jersey 2014 Report Card).

 

 The “Motherhood Violence Act” states that the death of a pregnant mother rules as a homicide. The bill also states that the death of an unborn child (because of the death of the pregnant mother) rules as another homicide with independent charges provided (New Jersey Legislature). 

 

The "Post-Viability Protection Act" states that an abortion can only be performed by a practicing physician only if the gestational age of the unborn child during that time is 20 weeks or greater (New Jersey Legislature).
